Federal Issue: Offshoring

Due to the increase in the phenomena of U.S. firms sending geospatial, engineering and architectural work to offshore subcontractors, particularly given the heightened awareness of data security after the attack of September 11, 2001, MAPPS asked the law firm of Crowell & Moring LLP to examine the risks that firms might face on contracts with the federal government if, without the government’s knowledge and consent, they were to utilize offshore labor to perform such contracts. A MAPPS task force also reviewed this issue. The 2004 Crowell & Moring opinion was intended to inform firms of requirements and responsibilities under the law and order to assist firms with compliance.
